Terms and Conditions (T&C) for the Use of the "ToiletSpotr" App

 

 

 

1. Scope

 

These Terms and Conditions (T&C) govern the use of the "ToiletSpotr" app (hereinafter referred to as "App"), provided by Nathaniel Buesing / NB-Apps (hereinafter referred to as "Provider").
By downloading, installing, and/or using the App, you agree to these T&C. If you do not agree with them, you must not use the App.

 

 

2. App Features

 

The App offers the following main features:

  1. Restroom search at your current location or worldwide.
  2. Filters for accessible and free-to-use restrooms.
  3. Save and manage favorite restroom locations.
  4. Save and display the location of your parked vehicle.
  5. Navigate to restrooms or your vehicle's location using external map apps.
  6. Intuitive icons to distinguish between public, paid, and accessible restrooms.

 

The Provider reserves the right to further develop, modify, or remove features of the App at any time.

 

 

3. Usage Requirements

 

  1. Device Compatibility: The App is optimized for mobile devices and requires a compatible operating system.
  2. Permissions: Certain features require access to the device’s location. This is necessary to deliver relevant results and optimal usability.
  3. Costs: The App is free to use. A one-time in-app purchase is available to remove ads.

 

 

4. Disclaimer of Liability

 

  1. Restroom Availability: The Provider does not guarantee the availability, accuracy, or timeliness of the restroom data shown.
  2. Third-Party Services: Navigation is performed using external map apps. The Provider assumes no liability for errors or malfunctions caused by such services.
  3. Damages: The Provider is not liable for direct or indirect damages resulting from the use of the App, unless caused intentionally or through gross negligence.

 

 

5. Data Protection

 

Personal data is processed in accordance with our Privacy Policy, which is accessible through the App. It describes how we collect, use, and protect your data.

 

 

6. Intellectual Property

 

All rights to the App, including its design, functionality, texts, images, and source code, remain with the Provider. Unauthorized use, reproduction, or distribution is prohibited.

 

 

7. Changes to the T&C

 

The Provider reserves the right to change these T&C at any time. Changes will be communicated within the App. Continued use of the App after such notice constitutes acceptance of the updated T&C.

 

 

8. Termination of Use

 

The Provider may discontinue the App or individual features at any time. You may also terminate use by uninstalling the App.

 

 

9. Jurisdiction and Applicable Law

 

These T&C are governed by German law. The place of jurisdiction is the Provider’s registered office, provided the user is a merchant.
